finance comapny and land of leather

Back in 2008 i bought furniture from land of leather. It was on the interest free for the first year thing. I never paid within the first year because of a mix up when i was suppose to pay, Anyway there was a problem with the furniture and i wasnt happy with the quality of the leather so i was already in discussion with getting it replaced. In the long run they came and took the sofa back but still took the money out of my account for 3 months. After months and months of phone calls trying to get the money back i could no longer get through to the number so i kind of just left it and forgot about it. Today i receive a letter from a debt collecting agency looking for the money as they have been appointed to collect this debt.There is no debt, only they owe me €136. Im worried sick over this now, i have no proof they took the furniture back.... what am i suppose to do?

Who was the finace taken out with. Usually it's through a different company, you borrow the money from them and they pay Land of Leather. Your contract is with the finance company. It's usually a 4 yr contract with a clause that if you pay in full at the end of the 12 months you don't pay interest, if you are even a day late the years interest gets added on.

How many months was the agreement for, how many have you paid? If the agreement is with a different finance company you must inform them that the goods were returned and the agreement is to be cancelled. Did you get a different sofa as a replacement or am I Reading it correctly that you paid for over a year and have no sofa at all now
The debt has been sold now to a debt collection agency so they own the debt. How much are they saying that you owe. Did you cancel the standing order?
I would advise you to contact the debt collection agency and explain the situation and see what they say. Also contact land of leather, if the sofa was returned then they should have refunded the finance company. As far as I know the onus is on you to inform the finance company the goods have been returned and they cancel the contract and seek a clawback from the store. Pm me the name of the finance company, one I used to work for closed it's Irish office some time back, I'd say it's the one you dealt with.

Hey the finance was taken out with creative something... Yes it was over four months with the option to pay before 12 months interest free. The sofa was returned before the 12 months was over but they still went in to my account and took the money for 3 months without me noticing. So we were left with no sofa. I rang on numours occasions trying to get our 3 months back but nothing and then i just gave up . Ive tried to ring them but there is noone on the phone so i have to email them, however the debt collection agency have put the account on hold and they will contact them too.

The payments are taken out with a standing order so the bank will continue sending the company payments until you cancel it. The company would have had no access to your account to actually take the money.

It seems to me that the finance company are not aware that the sofa has been given back so the agreement is still active on their account and
has gone into arrears. I'm surprised you haven't received letters and calls from their collections dept.

If you sent the goods back for being faulty the agreement should have been cancelled (by you) and you would have been entitled to have your payments refunded. It sounds to me like you have paid a few hundred euro but have nothing to show for it?

Wait and see what the debt collection agency have to say.
What did LOL say when they took the sofa back? Contact a manager there and explain the situation. If the agreement hasn't been cancelled the LOL have gotten paid for the sofa from the finance company, still have the sofa and you are the one that lost out. If the
agreement was cancelled they would have had to refund the money to the finance company who in turn would refund your payments.

If I'm picking all this up correctly then you should be entitled to have all money you paid refunded.
